Civil law attorney in Metz

A contractor who does not finish the work, a landlord who keeps the deposit, a neighbour who encroaches, an estate that stalls, a bank that demands payment: civil law is the law of everyday life, and in Metz it has a particularity, the local law of Alsace-Moselle. From the office on rue Coislin, I assist individuals and small businesses within the district of the tribunal judiciaire de Metz (the Metz civil court), from negotiation to the hearing.

When to consult a civil law attorney in Metz

As soon as a letter goes unanswered, a significant sum is at stake or a deadline is running. Many disputes are settled before the hearing if the file is built early.

  • A contract is not being performed: unfinished work, a disputed sale, a non-conforming service, a contested invoice.
  • You are in conflict with your landlord or your tenant: unpaid rent, security deposit, inventory of fixtures, notice to quit.
  • A neighbour is causing a nuisance, encroaching on your land or contesting a property boundary.
  • Your bank or a credit institution is claiming sums from you, has listed you or gave you poor advice.
  • A separation, a divorce, child custody or maintenance must be organised before the family court judge in Metz.
  • An estate is stalled between heirs or a division must be organised, including with property recorded in the land register.

Contracts, consumer law and banking disputes

The law of contracts, reformed in 2016, offers precise tools: withholding performance, price reduction, termination, damages. Against a business, the Consumer Code adds the statutory guarantee of conformity, the right of withdrawal and the ban on unfair terms. The firm always begins with a reasoned formal notice, which is often enough, and then brings the appropriate proceedings before the tribunal judiciaire de Metz or, for small claims, a simplified procedure.

Disputes with a bank or an insurer have their own rules: the duty to warn, the annual percentage rate, borrower insurance, listing on the FICP register, the two-year limitation period for consumer credit. The banking dispute guide sets out the remedies.

Property, leases and neighbours: the Moselle land register

In Moselle, property ownership is not published at a land registry office but recorded in the livre foncier (land register), kept at the tribunal judiciaire under the supervision of a judge (Act of 1 June 1924). This registration has particular evidential force: it changes how an easement, a boundary or a mortgage is proved, and therefore how a neighbour, boundary or party wall dispute is argued. Abnormal neighbourhood nuisance, now codified in article 1253 of the Civil Code, comes on top of this.

Residential leases are governed by the Act of 6 July 1989 and by the protection disputes judge; commercial leases by the tribunal judiciaire. Construction disputes (defective work, ten-year guarantee, late delivery) almost always involve a court-ordered expert assessment. See the neighbour dispute guide.

Family and estates before the tribunal judiciaire de Metz

The juge aux affaires familiales (family court judge) in Metz rules on divorce, the children's residence, contact and staying rights, maintenance and the compensatory allowance. Since 2021, divorce proceedings are started by a writ or a joint application, with an orientation hearing on interim measures. Divorce by mutual consent is signed before a notary, with one lawyer per spouse.

Contested estates (judicial division, concealment of assets, hotchpot of gifts, joint ownership) also fall to the tribunal judiciaire. For families in which one member lives or works in Luxembourg, the question of the competent court and the applicable law comes first: the guide to divorce and child custody France-Luxembourg explains it. Child protection measures are covered on the juvenile law page.

Alsace-Moselle local law: what is different in Metz

A legacy of the 1871-1918 period, local law still applies in the departments of Moselle, Bas-Rhin and Haut-Rhin. Besides the land register, it provides a civil bankruptcy procedure for over-indebted individuals acting in good faith (articles L.670-1 et seq. of the Commercial Code), which allows debts to be wiped out through a liquidation procedure, whereas the rest of France only has the personal recovery procedure. Registered associations entered in the court's register, the regime governing religious bodies and two additional public holidays are other examples.

These rules cannot be improvised: they are learned by practising before the Moselle courts. That is one of the practical reasons for choosing a lawyer admitted to the Metz Bar rather than a firm from outside the court district.

Frequently asked questions

Do I need a lawyer for a civil dispute in Metz?

A lawyer is compulsory before the tribunal judiciaire when the claim exceeds EUR 10,000, as well as in most family proceedings and complex property cases. Below that, a lawyer remains optional but useful: building the file, drafting the submissions and anticipating the compulsory prior conciliation attempt avoid costly mistakes.

How much does a civil law attorney in Metz cost?

The first appointment is free. A written fee agreement then sets a fixed fee per stage or an hourly rate, and a results-based fee may supplement a moderate fixed fee. Your legal protection insurance may cover part of the fees; legal aid is available subject to means.

How long do civil proceedings take before the tribunal judiciaire de Metz?

From a few weeks for summary proceedings to one or two years for a full trial with an expert assessment. The amicable phase, formal notice followed by negotiation or mediation, settles a significant share of cases within two to four months. The duration depends above all on whether an expert assessment is needed and on the workload of the division hearing the case.

What is the land register (livre foncier) and why does it concern me?

In Moselle, every right in land (ownership, easement, mortgage) is recorded in the livre foncier kept at the tribunal judiciaire. Registration creates a presumption that the right exists. Before any dispute over a boundary, an easement or a sale, the land register extract must therefore be consulted, which the firm does systematically.

Does civil bankruptcy apply to me?

It applies to individuals domiciled in Moselle, Bas-Rhin or Haut-Rhin who are acting in good faith, are notoriously insolvent and are neither traders nor craftsmen. It is ordered by the tribunal judiciaire and results in the discharge of debts not covered by the liquidation. It is distinct from the over-indebtedness procedure before the Banque de France, which remains available in parallel.
